The BANQMART AFFILIATE PROGRAM (“Program”) is offered at the sole discretion of BanqMart (“BanqMart”, “we,” “our” or “us”). The Program is available to individuals for their personal use only and is limited to one account per individual. Corporations, associations or other groups may not participate in the Program.

By joining the program and becoming a program member, you (individually and collectively, “you,” “your,” or “Member”), agree that you have read, understood and agree to be bound by these program terms and conditions of participation (“program terms”) and by any changes or modifications we may make. You should review these program terms and the related policies frequently to understand the terms and conditions that apply to the program as they may change from time to time. These program terms do not alter in any way the terms or conditions of any other agreement you may have with us, including any agreement for products or services. By enrolling in the program, you also agree to be bound by our privacy policy and our website Terms and Conditions, which are incorporated on the website. If you do not agree to these program terms, our privacy policy, and our website terms and conditions, you cannot participate in the program. The program is void wherever it is prohibited by law.

We are entitled to act on all instructions received by anyone using your account and are not responsible for any transaction made without your authorization.

You agree that we may transfer your personal data, or the personal data for the purposes of facilitating a transaction and providing sales support for a transaction.

You consent to receive transactional, commercial and marketing communications both related to BanqMart specifically, and to our other products and services generally (including new products or services), from us electronically, except in those jurisdictions where your express consent is required to receive commercial or marketing communications electronically. Commercial and marketing communications may include notifications about relevant special offers or opportunities available from our partners. In such an event, we will send you commercial or marketing communications electronically only if you have provided your express consent by proactively opting-in to receive such communications from BanqMart regarding its products and services.

Please read the terms and conditions carefully. If you do not accept all of these terms and conditions, please do not register for the program. We reserve the right, at any time, to modify, alter, or update these terms and conditions of use. We will notify you of such changes by email at the address you registered with or by prominent notice on the website. Your continued usage of the website following such notification shall constitute your acceptance of the changes. If you do not agree to any such changes, you must immediately cease using the website.

Eligible individuals may only enrol in the program by visiting https:// banqmart.com/ (collectively, the “website”) or BanqMart’s mobile app and following the program details to register for the program.

You shall get registered with BANQMART’S AFFILIATE PROGRAM by filling the form provided on our website with required information like full name, address, date of birth, email address, phone number, IBAN, Emirates ID, bank, credit card details etc. to get qualified for the Affiliate program. While registering as a new user, your email address will be used as your login identification, and you will be required to provide a unique password for your account. We shall validate your email id and phone number for the purpose of registering to the program. You are solely responsible for maintaining the accuracy of your account information and for updating it as required. You may update your personal information on the website. You are also responsible for keeping your user ID and password confidential.

Only one program account may be associated with a single email address. In the event of a dispute over ownership of the program membership account, the member will be deemed to be the authorized account holder of the email address submitted at the time of enrolment. For purposes of these terms, the 'authorized account holder' is the natural person who is assigned to the submitted email address by an internet provider, an online service provider that is responsible for assigning email addresses for the domain associated with the submitted email address.

Every registered member can login using their respective credentials and shall have a separate dashboard which gives details about your account profile, accumulated Affiliate points, redemption status, transaction status etc.

Once you have become a registered member to the program, you can begin racking up affiliate points(“Points”) by the following way:

Promote Our Products/Services: every time when a registered member and promote our products/services to any of your friends, relatives, colleagues etc. (“Promoter”), through our website and they sign up with BanqMart and purchase any of our products/services offered by BanqMart through our website, then the member shall be eligible for our affiliate points, as per the points table stated below.

Banqmart Affiliate Program Benefits

BanqMart reserves the right to suspend, terminate, revalue or modify, without liability to members, all or part of the points’ value structure and offers and any merchandise or service.

For every promotion, a unique Affiliate code shall be generated through the system and when the person to whom the promotions were made purchases any of the products/services offered by BanqMart through our website, the affiliate code shall get verified against the transaction and the respective member/promoter shall earn affiliate points against the successful completion of the transaction. The affiliate code is a system generated one, and it shall get generated only once for every specific promotion made by the member/ promoter. If a person to whom the promotions were made purchases multiple products or does repeated purchases, the member shall be eligible for affiliate points only once and not for the subsequent transactions.

Members can check your affiliate points balance on your account page on a real-time basis by logging into the site with the username and password.

In case of any grievances with respect to the affiliate program, members shall send an email to: Info@banqmart.com with all relevant information. Such grievances emails must specify the name, the date of the program activity, and the issue(s) you encountered. This email must be sent no more than fifteen (15) days after the date the purchase or other Program activity took place. We are not responsible for late notifications about purchases or other program activities not being credited to an account. However, BanqMart reserves the right to adjudicate all matters related to the program including the points discrepancies in its sole discretion, and the members agree to abide by any such adjudication.

All points earned in a month shall get reset to zero by the end of every month. So, the members shall use all the accumulated affiliate points earned by them during the calendar month the same month itself either as cash reward or merchant vouchers. Please review the website on a regular manner to know redemption details which are subject to change from time to time. In case if the member is opting for Cash reward, then affiliate points earned in that particular month and it’s equivalent cash value shall get automatically redeemed and encashed to the registered bank account or gift card or prepaid card or alternative method of payment within 45 days from the date of redemption. Hence, every point earned by a member in a particular month shall be redeemed immediately in the same month itself and there shall not be any carry forward of the affiliate points. (For example: all points a member earned during the month of January shall automatically be redeemed to his/ her registered bank Account by 15th February.) For point redemption through merchant vouchers the member needs to check the website for merchandise and various options which may get revised periodically

BanqMart shall not be responsible for any non-redemption of the points due to wrong entry of any details provided by you or non-activation of the registered account information.

The value of the points shall get changed as per the discretion of BanqMart, which shall be notified on the website from time to time.

BanqMart may, in its sole and absolute discretion, cancel, change, suspend, or modify any aspect of the program and/or any reward at any time, including the availability of any reward. BanqMart may, in its sole and absolute discretion, terminate or suspend any member’s participation in the program for breach of these program terms and conditions, or for taking any actions that are inconsistent with the intent of these program terms and conditions. BanqMart reserves the right at its sole discretion to prohibit any member from participating in any aspect of the program if BanqMart deems or suspects that such member has engaged in or has attempted to engage in any of the following:(a) acting in violation of these program terms and conditions; or (b) damaging, tampering with or corrupting the operation of the program or website; or(c) acting with intent to annoy, harass or abuse any other person; or(d) any inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, or unusual behaviour or activity; or(e) activity deemed in the sole discretion of BanqMart to be generally inconsistent with the intended operation of the program. Any decision BanqMart makes relating to termination or suspension of any member’s participation in the program shall be final and binding in all respects. BanqMart shall be the sole determiner in cases of suspected abuse, fraud, or breach of these program terms and conditions or intent of these program terms and conditions.

By participating in the program, members agree to release BanqMart, its parent company, partners, customers, subsidiaries, affiliates, suppliers, advertising and promotions agencies and their respective directors, officers, employees, and agents (collectively, “Released Parties”) from any and all liability for any loss, harm, damages, cost or expense, including, without limitation, property damages, personal injury and/or death, arising out of or in any way connected to the program or the use of any affiliate points/rewards.

Members agree to indemnify, defend and hold BanqMart and its representatives, and agents like parent company, partners, customers, subsidiaries, affiliates, suppliers, advertising and promotions agencies, harmless from and against any and all third-party claims, demands, liabilities, costs or expenses, including attorney’s fees and costs, arising from, or related to any breach by member of any of these program terms and conditions or any violation by member of applicable law

NEITHER BANQMART NOR OUR PARENTS, SUBSIDIARIES, AFFILIATES, PARTNERS, OR LICENSORS MAKE ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, IN CONNECTION WITH THESE TERMS OR THE PROGRAM OR ANY OF THE REWARDS OR BENEFITS ASSOCIATED WITH THE PROGRAM INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR APARTICULAR PURPOSE, EXCEPT TO THE EXTENT SUCH REPRESENTATIONS AND WARRANTIES ARE NOT LEGALLY EXCLUDABLE.

YOU AGREE THAT NEITHER BANQMART NOR OUR PARENTS, SUBSIDIARIES, AFFILIATES, PARTNERS, OR LICENSORS WILL BE RESPONSIBLE OR LIABLE IN CONTRACT, WARRANTY OR IN TORT (INCLUDING NEGLIGENCE) FOR ANY (a) INTERRUPTION OF BUSINESS; (b) ACCESS DELAYS OR ACCESS INTERRUPTIONS TO THE PROGRAM; (c) DATA NON-DELIVERY, LOSS, THEFT, MISDELIVERY, CORRUPTION, DESTRUCTION OR OTHER MODIFICATION; (d) LOSS OR DAMAGES OF ANY SORT INCURRED AS A RESULT OF DEALINGS WITH OR THE PRESENCE OF THIRD PARTY LINKS ON THE SITE OR USE OF ANY REWARD OR BENEFIT OF THE PROGRAM; (e) COMPUTER VIRUSES, SYSTEM FAILURES OR MALFUNCTIONS WHICH MAY OCCUR IN CONNECTION WITH YOUR USE OF THE SITE, INCLUDING DURING HYPERLINK TO OR FROM THIRD PARTY WEBSITES; (f) ANY INACCURACIES OR OMISSIONS IN PROGRAM CONTENT; OR (g) EVENTS BEYOND OUR REASONABLE CONTROL.WE MAKE NO REPRESENTATIONS OR WARRANTIES THAT DEFECTS OR ERRORS WILL BE CORRECTED.

FURTHER NEITHER BANQMART NOR OUR PARENTS, SUBSIDIARIES, AFFILIATES, PARTNERS, OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) RELATED TO THE PROGRAM OR AND YOUR PARTICIPATION THEREIN, WHETHER IN CONTRACT, WARRANTY OR IN TORT (INCLUDING NEGLIGENCE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND IN NO EVENT SHALL OUR MAXIMUM AGGREGATE LIABILITY FOR SUCH CLAIMS EXCEED ONE THOUSAND ARAB EMIRATES DIRHAM (AED 1000.00).

YOU AGREE THAT NO CLAIMS OR ACTION IN CONTRACT, WARRANTY OR IN TORT (INCLUDING NEGLIGENCE) ARISING OUT OF, OR RELATED TO, YOUR PARTICIPATION IN THE PROGRAM, USE OF ANY REWARDS OR OTHER BENEFIT OR THESE TERMS MAY BE BROUGHT BY YOU MORE THAN ONE (1) YEAR AFTER THE CAUSE OF ACTION RELATING TO SUCH CLAIM OR ACTION AROSE. IF YOU ARE DISSATISFIED WITH THE PROGRAM, TERMINATION OF YOUR MEMBERSHIP IN THE PROGRAM IS YOUR SOLE REMEDY. WE HAVE NO OTHER OBLIGATION, LIABILITY, OR RESPONSIBILITY TO YOU.

The content and information on this BanqMart website, as well as the infrastructure used to provide such content and information, is proprietary to us, our suppliers and/or our program partners. You are licensed to use our website solely for the purpose set out above. You are not permitted to copy our program, or its terms and you shall also agree not to:

• make any speculative, false, or fraudulent claims about your membership to the affiliate program or make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;
• access, monitor or copy any content or information of this website/ program using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;
• violate the restrictions in any robot exclusion headers on this website/ program or bypass or circumvent other measures employed to prevent or limit access to this website/program;
• take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;
• deep-link to any portion of this website (including, without limitation, the purchase path for any transaction) for any purpose without our express written permission; or

Member hereby expressly consents to exclusive jurisdiction and venue in the courts located in UAE for all matters arising in connection with these program terms and conditions or member’s participation in the program.
